Our Services

In most industries today, customers want customization and choices. From intellectual property to insurance to construction, consumers and businesses alike are demanding flexible solutions for their unique needs. So to with ADR.

New England Dispute Resolution has forged its reputation by tailoring dispute resolution programs to meet the specific objectives of the parties involved. From expedited mediation to arbitration to case evaluations, NEDR crafts the right combination of services, rules & neutrals for the task at hand.

Arbitration

In arbitration, a neutral third party conducts a hearing where the parties and their attorneys present written and oral evidence.

The parties can choose to have the case heard by a single arbitrator or a panel of three arbitrators.

The rules of evidence are relaxed, allowing the parties more latitude in speaking their minds. This opportunity may enhance each party's satisfaction with the process.

Following the hearing, the arbitrator renders a written decision. The opinion enables the parties to understand the reasons for the decision and, therefore, to accept it as a resolution of the dispute. The arbitrator's decision is final and binding.

Mediation

In mediation, a neutral third party facilitates a discussion between the parties and their attorneys, and keeps them focused on options to resolve the dispute.

Initially, the parties meet collectively with the neutral to discuss the facts of the case. Then the parties typically adjourn to separate rooms. Although the neutral assists in settlement negotiations, the parties retain decision-making power.

Any resolution comes from the parties and therefore meets their needs and interests. Mediation produces a voluntary, win-win solution. The parties are free to pursue litigation if their case is not resolved in mediation.
